Privacy Policy

Your privacy is important to us in Mylando. (“Mylando”, “we”, “us” or “our”), therefore we developed this ˝Privacy Policy˝ to explain the procedures for collecting and using Mylando information regarding the Service. The privacy policy is part of the agreement, and by using the service you agree that you have read it, that you understand it and that you will abide by it. If you see capitalized terms that are not defined in this Privacy Policy, they will have the meaning given to them elsewhere in the Agreement. 

1. Data controller 

Mylando is a data controller for the processing of personal data about you as a Service User.

2. Definitions

"Data controller" means a natural or legal person, public authority, agency or otherwise a body that alone or together with others determines the purposes and means of processing personal data; if the purposes and means of such processing are determined by Union or Member State law, the controller or special criteria for his appointment may be provided for by European Union law or Member States; "GDPR" means the General Data Protection Regulation (EU) 2016/679;

“Personal data” is any information relating to a natural person who is identified or can be identified; an identifiable person is a person whose identity can be established directly or indirectly, in particular on the basis of an identification number or one or more features specific to his/her physical, psychological, mental, economic, cultural or social identity.

"Violation of personal data" means a breach of security that leads to accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access to personal data transmitted, stored or otherwise processed;

"Processing" means any action or set of operations performed on personal data or sets of personal data, whether by automatic means, such as collecting, recording, organizing, structuring, storing, adapting or modifying, searching, disclosuring, transfering, disseminating or otherwise making available, compliant or a combination of given, restricting, deleting or destructing;

"Processor" means a natural or legal person, public authority, agency or any other body which processes personal data on behalf of the controller;

"Special categories of personal data" means personal data that reveals racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership and processing of genetic and biometric data for the purpose of physical identification, data relating to health, data relating to sexual life or sexual orientation of a person.

3. Access to personal data                                                       

Only Mylando employees who need access to personal information to perform their work tasks process personal data. All of these employees have entered into agreements on confidentiality.



4. The right of access to personal data                                  

You have the right to receive confirmation from Mylando as to whether personal data about you will be processed, and if so, access to your personal data and the following information:

  • purpose of processing;
  • categories of personal data;
  • recipients or categories of recipients to whom personal data have been or will be disclosed
  • recipients in third countries, ie. countries outside the EU / EEA;
  • If possible, the intended period for which the Personal Data will be stored, or if not possible, the criteria used to determine that period;
  • the existence of a right to request Mylando to correct or delete personal data, limiting the processing of personal data concerning you and objections to such processing;
  • the right to lodge a complaint with the supervisory authority where personal data is not collected from you, all available information on the source of the existence of automated decision making, including profiling, from Article 22 (1) and (4) of the GDPR, and at least in those cases, significant information about the logic involved, as well as the significance and anticipation of the consequences of such processing for you. Where personal data is transferred to a third country, that is, a country outside the EU / EEA, or an international organization, you have the right to be informed of the appropriate safeguards in accordance with Article 46 of the GDPR which refers to the transfer.


5. Right to correction, etc.


Mylando aims to process only the personal data that is accurate and up to date.


Rectification:
You have the right to obtain from Mylando a correction of inaccurate personal data concerning you.

Right to forget:
You have the right to ask Mylando to delete personal data concerning you. Mylando has an obligation to delete personal data, inter alia, when Personal Data is no longer required for the purpose for which it has been collected or you have withdrawn the consent on which that processing is based.

Processing restriction:
You have the right to receive a processing restriction from Mylando if you have a special reason for the defect
limitations. This may be if you have problems with the content of the information we hold or how we have processed your personal data. This may also be the case when Mylando no more needs personal data for processing purposes, but you seek to establish, execute or defend legal claims.

Data transfer:
You have the right to receive personal information about you, which you have given to Mylando, in a structured, usual form and machine-readable form and you have the right to transfer this data to another data controller without interference from Mylando where the processing is based on consent, contract or processing is performed by automated means.

Profiling:
You have the right to object to the processing of personal data concerning you on an automated decision basis and / or profiling. This does not apply if the data is necessary for the compilation or execution of the contract between you and Mylando or is legally binding.

Right to appeal:
You have the right to lodge a complaint with the supervisory authority.

6. Data processing contracts


Mylando cooperates with other companies that process personal data on behalf of Mylando.
Mylando uses only those data processors that provide sufficient guarantees that implement appropriate technical and organizational measures in such a way that the processing requirements of the GDPR will be met and ensure the protection of the rights of all entities concerned. Processed data is governed by a contract that binds the data processor in relation to Mylando and which states the subject and duration of processing, the nature and purpose of processing, the type of personal data and categories of data carriers and the obligations and rights of Mylando and the data processor.


7. Personal data we collect and / or receive


When you sign up to become a user or when you buy a product, you may have to give personal information about yourself, including, without limitation, your name, phone number, email address and profile picture. The legal basis for such processing is the execution of the contract with you. If you contact us via the "Contact Us" page, you will need to enter your name and other contact details. We do not collect any personal information from visitors or users when using the service, unless they voluntarily provide such information. Some of personal data provided (Username, product and / or store you choose to save to your profile, Users you follow and Users who follow you) will be publicly available through the Service, and we will not share this publicly available personal information with other users or elsewhere on the Service, alone or in connection with other information relating to your activities on the Service or any User Content you have provided. In order to process all transactions through the Service, such as a product or application, you may need to provide certain billing information, such as information related to your PayPal account, debit card number, credit card number, expiration date, bank account information, billing address, activation code and similar information (common "Billing Information"). This billing information may be collected and processed by third party payment providers ("Payment Platform") in accordance with the terms and conditions of their privacy policy and terms of use. If we get access to your billing information regarding these transactions, we promise not to share it with third parties, unless it is necessary to process your transaction or administer the service.



8. Personal data collected by or through third party companies


We may share the information listed under 1, 2 and 3 in Section 6 above about your activity on the Website with third parties for the purpose of customizing, analyzing, managing, reporting and optimizing the advertising you see on the Website and elsewhere. These third parties may use cookies, pixel tags (also called web beacons or clear gifs) and / or other technologies for collecting such information for such purposes. Pixel tags give us the ability to recognize these third-party advertisers and  the browser cookie when the browser visits the web location of the pixel tag to find out which ad brought a user to a particular place.


9. How we use and share personal information


We may use Personal Information to provide and improve our website, services and other products and services; process the transactions you request; inform you about our products and services and our promotional partners; and bring you customized content (such as a newsletter) based on your service-related activities. These other companies will have access to Personal Data only when necessary to perform their function to the extent permitted by law. In a continuous effort to better understand our Visitors, Users, Website, Service, other products and services and those of our promotional partners, we may analyze certain information in an anonymous and aggregate form. This aggregate information does not identify you personally. We can share and / or license this aggregate information to our affiliates, agents, businesses and promotional partners and other third parties. We may also disclose aggregated user statistics to describe the Website and these products and services to current and future business partners and other third parties for other legitimate purposes. 10. Access and change of personal data


Users can access Data and communication settings , remove, view and / or change their personal information by following the instructions found on the website. In addition, you can manage the receipt of marketing and non-transactional communications by clicking on the link "check out" located at the bottom of any Mylando email marketing. We will use commercially reasonable efforts to process such requests in a timely manner. However, you should be aware that it is not always possible to completely remove or change the data in our subscription databases. Users and job applicants cannot give up receiving transactional emails associated with their Mylando account.


11. How we protect personal information


We take reasonable steps to protect personal information from loss, misuse, unauthorized access, disclosure, alteration or destruction. However, please understand that the security system is not impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the personal data you provide will not be intercepted while being transmitted to us via the Internet. In particular, email sent to or from a website may not be secure, therefore you need to be especially careful when deciding what information to send by email. 

Transfer of personal data to other countries; The Service, the Website and its servers may be operational in the European Union (EU), the United States or elsewhere. Keep in mind that Your personal information may be transferred, processed, maintained and used on computers, servers and systems located outside the state, province or other state jurisdiction, where privacy laws may not be equally protective like those in your. In the event that personal data is processed outside the EU / EEA, the level of protection is guaranteed by the decision of the European Commission that the state where data is being processed has an appropriate level of protection of personal data or the application of appropriate security measures such as binding corporate rules or a privacy shield.



12. External websites


The website may contain links to external websites. Mylando has no control over the privacy practices of external websites and we are not responsible for the content or privacy policies of those external sites. You should check the applicable third party privacy policies and terms of use when visiting any external site.


13. Children


We unknowingly collect personal information from children under the age of 13 through the website. If you are under 13, do not give us any personal information. We encourage parents and legal guardians to monitor their children's Internet use and help enforce our privacy policy by instructing children to never provide personal information through websites without your permission. If you have reason to believe that the child younger than 13 years of age provided personal information, please contact us at legal@mylando.com and we will endeavor to delete that information from our databases.
